AGREEMENT OVERVIEW: This Agreement expresses the full and complete agreement between the CLIENTS (Partner 1 and Partner 2, named below) and SAMANTHA OATES  PHOTOGRAPHY regarding the subject matter hereof. It supersedes all prior agreements. The only way to add or change this agreement is to do so in writing, and agreed by all parties.

COOPERATION: Unless otherwise noted,  SAMANTHA OATES PHOTOGRAPHY, it's associates or employees will be the exclusive photographer(s) at this event. The Parties agree that good faith cooperation and communication between them is important in obtaining a good result. SAMANTHA OATES PHOTOGRAPHY recommends that CLIENTS identify to the photographer(s) important individuals during the event and during associated portraits, if they wish to have them photographed.  SAMANTHA OATES PHOTOGRAPHY or the photographer(s) will not be held accountable for not photographing desired guests if there is no one to assist in identifying and gathering people for photographs. SAMANTHA OATES PHOTOGRAPHY is not responsible if key individuals fail to appear or cooperate during photography, or for missed images due to details not revealed to SAMANTHA OATES PHOTOGRAPHY or beyond the photographer(s) control.

HOUSE RULES: CLIENTS agree and understand that the photographer(s) are limited by the guidelines of the ceremony official or reception site/venue management and CLIENTS agree to accept the results that may occur from said guidelines. Negotiation with the officials/management for moderation of guidelines is solely the CLIENTS responsibility.

ENGAGEMENT SHOOT: SAMANTHA OATES PHOTOGRAPHY provides a complimentary engagement shoot to all couples prior to their wedding. It is up to the CLIENTS if they would like to book this session. If CLEINTS choose not to the book an engagement shoot, it cannot be redeemed for cash or for an additional hours of wedding photography coverage. If CLIENTS would like to book an engagement shoot, CLIENTS agree to book a minimum of three months in advance of their desired date.

WEDDING SCHEDULE: CLIENTS agree to provide SAMANTHA OATES PHOTOGRAPHY a detailed schedule for the full day of the wedding, including all times and locations. A schedule must be emailed to  SAMANTHA OATES PHOTOGRAPHY 7 days before the wedding.

FAMILY AND FRIEND SHOT LIST: CLIENTS agree to provide SAMANTHA OATES PHOTOGRAPHY a detailed shot list of family and friends. This list must be emailed to  SAMANTHA OATES PHOTOGRAPHY 7 days before the wedding.

IMAGES, EDITING and COPYRIGHTS: Photographs/images produced by SAMANTHA OATES PHOTOGRAPHY are protected by Copyright Law (all rights reserved). Upon final payment by CLIENTS, CLIENTS are allowed to display resulting images for personal use. Said images may not be altered or reproduced in any manner without prior written permission of SAMANTHA OATES PHOTOGRAPHY. CLIENTS will receive a high-resolution digital disk/USB with printing rights, and may make prints for personal use, but may not copy, or re distribute the disk/USB for commercial use. The CLIENTS must obtain written permission from SAMANTHA OATES PHOTOGRAPHY prior to the CLIENTS, their associates, friends or relatives selling the photographs or publishing them commercially (E.g., Newspaper, Magazine). SAMANTHA OATES PHOTOGRAPHY will choose the best images from engagement session and wedding day.  SAMANTHA OATES PHOTOGRAPHY does not show unedited images, nor involve clients in the process of choosing which images will be chosen for the final gallery SAMANTHA OATES PHOTOGRAPHY spends a great deal of time going through each image individually. Please rest assured that SAMANTHA OATES PHOTOGRAPHY will only show you the BEST of the BEST and any images that do not meet our high professional standards will get deleted immediately. Please note what defines SAMANTHA OATES PHOTOGRAPHY “edited” images include colour correction, colour enhancements, exposure correction, shadow and highlight recovery, lens correction, and a little artistic flare.  SAMANTHA OATES PHOTOGRAPHY edited images do not include retouched or photo-shopped images. This is a service SAMANTHA OATES PHOTOGRAPHY does not offer. Retouching/photo-shopping images can be an art form in itself, and can require extensive, skilled work. Please note, SAMANTHA OATES PHOTOGRAPHY will usually retouch a few photos within a wedding collection. This is at SAMANTHA OATES PHOTOGRAPHY's own discretion whilst editing, and usually does not extend beyond 10-30 images.

MODEL RELEASE: The CLIENTS hereby grants to SAMANTHA OATES PHOTOGRAPHY and successors, heirs, executors, administrators, assigns, attorneys, representatives and agents, the irrevocable and unrestricted right to use and publish photographs of the CLIENTS or in which the CLIENTS may be included, for editorial, trade, advertising or any other purpose and in any manner or medium; to alter the same without restriction; and to copyright the same. The CLIENTS hereby release SAMANTHA OATES PHOTOGRAPHY and all associates representatives and assigns from any and all claims, actions, demands, suits, liabilities, damages, expenses, and obligations of any kind arising from, or related in any manner to SAMANTHA OATES PHOTOGRAPHY's use of said images.

RETAINER, REFUND & PAYMENT SCHEDULE: A non-refundable fee to the amount of 50% of total package price (deducted from the chosen package) is due at the signing of this agreement. This is a NON-REFUNDABLE RETAINER. Should CLIENT cancel or otherwise breach this Agreement, the NON-REFUNDABLE RETAINER shall be liquidated for damages to SAMANTHA OATES PHOTOGRAPHY. The CLIENT shall also be responsible for payment of any materials/charges incurred up to time of cancellation. Otherwise, the retainer shall be applied towards the final total, with the remainder of charges payable in full, 1 week prior to the date of the event. SAMANTHA OATES PHOTOGRAPHY will not refund, nor accept the return of/refusal to pay charges for, any technically acceptable photograph supplied in an electronic format. No exception can be made as we cannot be held responsible for individual tastes or exceptions. Refunds of deposit or full payment will not be given to clients due to rescheduling because of increment weather, illness or change of mind.  The CLIENT'S booking fee is transferable to a new date within 12 months of your original date, provided SAMANTHA OATES PHOTOGRAPHY is available. The booking fee is non-refundable as it guarantees the CLIENTS wedding date and excludes all others from booking. If extra hours are added throughout the night, payments must be paid before images are handed over to CLIENTS.

LIMIT OF LIABILITY: In the unlikely event that the photographer(s) are injured, become too ill, or has an emergency that prevents them from photographing the event, SAMANTHA OATES PHOTOGRAPHY will make every effort to secure a replacement photographer. If a suitable replacement is not found, the CLIENTS agree that responsibility and liability of SAMANTHA OATES PHOTOGRAPHY to the CLIENTS is limited to the return of all payments received for the event. SAMANTHA OATES PHOTOGRAPHY takes the upmost care with respect to exposure, storage, and processing the photographs/images, but cannot and does not, guarantee that photographs/images of the event will not be lost, stolen, or destroyed for reasons within or beyond SAMANTHA OATES PHOTOGRAPHY control. CLIENT agrees that SAMANTHA OATES PHOTOGRAPHY or the photographer(s) full and complete responsibility and liability is limited to the return of all payments received for the event.

COMPLETION SCHEDULE: Images are expected to be edited within 4-6 weeks after the event date. No sneak peaks will be provided.  Printed items and albums will require additional time.

HOURS OF COVERAGE: Hours of coverage are continuous. SAMANTHA OATES PHOTOGRAPHY will take small breaks as necessary throughout this period and will confide in the CLIENT before doing so. Additional hours will be charged at $600 per hour. SAMANTHA OATES PHOTOGRAPHY will notify CLIENT(s) on the night when photography coverage is ending.  SAMANTHA OATES PHOTOGRAPHY will only stay for additional hours when given permission by bride and/or groom.
